The following Privacy Policy provides an overview of how ITHRA (which includes ITHRA DUBAI L.L.C and all of its subsidiaries, affiliates, companies under its management and other related companies (together “we”, “us” “our” or “ITHRA”) collect, use and process the Personal Data (as defined below) you or Data Subjects provide to us. This Privacy Policy applies to you because you are, will be or were a service provider or supplier of ITHRA and you have provided us with the Personal Data of individuals or individuals have provided their Personal Data directly to us in relation to the arrangement we have with you (“Data Subjects”).
This Privacy Policy sets out the rights of the Data Subjects whose Personal Data we have been provided with, in accordance with applicable data protection laws and regulations in the UAE, including the Federal Decree-Law No. 45/2021 On the Protection of Personal Data, as amended from time to time (“Data Protection Laws”).
- DEFINITIONS
For the purposes of this Privacy Policy, the below terms are defined as follows:
- “Personal Data” means any data relating to an identified natural person, or one who can be identified directly or indirectly by way of linking data, using identifiers such as name, voice, picture, identification number, online identifier, geographic location, or one or more special features that express the physical, psychological, economic, cultural or social identity of such person. It also includes Sensitive Personal Data and biometric data.
- “Sensitive Personal Data” means any data that directly or indirectly reveals a natural person’s family, racial origin, political or philosophical opinions, religious beliefs, criminal records, biometric data, or any data related to the health of such person, such as his/her physical, psychological, mental, genetic or sexual condition, including information related to health care services provided thereto that reveals his/her health status.
- WHO IS THE CONTROLLER OF PERSONAL DATA AND HOW CAN YOU CONTACT THEM
For the purposes of applicable Data Protection Laws, the applicable ITHRA entity which contracts with you will be a data controller processing the Personal Data of Data Subjects. This means that we are responsible for determining the purposes and means of processing your Personal Data. Depending on the data processing taking place, there may be more than one ITHRA entity processing your Personal Data.
You may also be a data controller as you separately collect, use and process the Personal Data of Data Subjects.
ITHRA is a property developer as well as a commercial and residential asset manager operating in the UAE.

- WHAT PERSONAL DATA AND SOURCES DO WE USE
Personal Data that we process in the context of our relationship with you may be obtained either directly from the Data Subjects or indirectly from other sources other than you, including from third parties, clients and other business contacts – by way of introduction, or from publicly available sources (e.g. Internet).
Categories of Personal Data may include but are not limited to:
- business contact details (e.g. name, phone number, e-mail address, office location, postal address and other business card details, as the case may be);
- identification data (e.g. passport copies, Emirates ID / government ID copies, etc.;
- authentication data (e.g. sample signature, sample initials, etc.);
- electronic identification data where required for the purpose of delivering products or services for ITHRA (e.g. login, password, access details);
- monitoring information (e.g. IT systems usage data, CCTV footage from our premises, electronic and telephone communications data etc.); and
- background screening / good conduct certificates / criminal record checks.
- WHAT DO WE PROCESS YOUR PERSONAL DATA FOR (PURPOSE OF PROCESSING) AND ON WHAT LEGAL BASIS
ITHRA processes Personal Data on various legal grounds (depending on the applicable Data Protection Laws) including:
- if the processing is necessary to perform a contract to which you are a party (e.g. business contract performance) and which relates to the Data Subjects;
- if the processing is necessary to fulfil obligations imposed on us by other laws in the UAE. ITHRA is subject to various applicable laws and regulations including in the areas of real estate, tax, corporate compliance and employment law; or
- as a result of Data Subject consent.
ITHRA processes Personal Data for various purposes which may include but are not limited to:
- onboarding you as one of our service providers or suppliers;
- managing a seconded resource that you provide to us;
- complying with applicable laws;
- marketing purposes; and/or
- for the performance of our contract with you.
- WHO RECEIVES PERSONAL DATA AND WILL THE DATA BE TRANSFERRED TO A THIRD COUNTRY
For the purposes described in this Privacy Policy, and subject to applicable Data Protection Laws, Data Subjects’ Personal Data may be shared with recipients outside of ITHRA, such as other ITHRA suppliers and service providers including:
- real estate managers;
- accounting;
- IT;
- security;
- marketing; and
- professional advisers that perform services on our behalf, our clients (tenants, leaseholders) as well as with other third parties such as banks, insurers, pension providers and government, public and judicial authorities, as the case may be.
ITHRA may transfer Personal Data to countries located outside of the UAE. This may happen when ITHRA’s suppliers and/or service providers are based outside of the UAE. ITHRA will transfer the Personal Data in accordance with applicable Data Protection Laws and use the applicable protection measures granted thereunder.
- HOW DO WE PROTECT YOUR PERSONAL DATA
ITHRA has implemented reasonable and appropriate technical and organizational security measures to protect Data Subject Personal Data against unauthorized access, disclosure, misuse, loss or destruction. This includes encrypting Data Subjects’ Personal Data, implementing data back-up measures and regularly conducting security testing.
- FOR HOW LONG WILL MY PERSONAL DATA BE STORED
ITHRA will process and store Data Subjects’ Personal Data only for as long as it is necessary in order to fulfil the purposes for which it was collected, including to meet its contractual and statutory obligations and/or to comply with legal, regulatory, accounting, reporting or internal policy requirements. It should be noted here that your contract with ITHRA may be a long-term obligation, lasting a number of years, and we will store Personal Data relating to our contract with you for the period of the contract, as a minimum.
If the Personal Data is no longer required in accordance with the above, it is deleted.
- DATA SUBJECT RIGHTS
Depending on the applicable Data Protection Laws, and subject to certain limitations under these laws, a Data Subject has certain rights in relation to their Personal Data. These include the right to:
- access their Personal Data;
- obtain and request the transfer of their Personal Data;
- correct and/or erase their Personal Data;
- restrict, and stop, the Processing of their Personal Data;
- object to, and stop, the Processing of their Personal Data; and
- object to decisions made by automated processing, that have legal consequences or seriously affect the Data Subjects.

A Data Subject should be made aware that they can withdraw any consent for the processing of Personal Data at any time. The withdrawal will not affect the lawfulness of any processing based thereon before the withdrawal.
Whilst we will make reasonable efforts to accommodate any Data Subject rights request to the extent, and as soon as reasonably practicable, we reserve the right to reject such requests or to impose restrictions or requirements upon such requests if required or permitted by applicable laws.
- USE OF PERSONAL DATA FOR DIRECT MARKETING
If a Data Subject has provided their consent for the purposes of marketing our products and services to them, we may process their Personal Data for such purposes. Any marketing by us, or any third parties on our behalf, will be conducted in accordance with applicable laws. Marketing includes, but is not limited to, contact by email, text message, social media and/or phone.

- ARE YOU OBLIGED TO PROVIDE THE PERSONAL DATA
We may require certain Personal Data to comply with our legal obligations or to pursue a business relationship with our service providers/suppliers. Without this Personal Data, we may not be in a position to continue our business relationship with you. We will notify you if this is the case.

- WHAT PERSONAL DATA AND SOURCES DO WE USE
We process Personal Data in a variety of ways when you interact with ITHRA, both physically and online. Some examples include:
Personal Data that we obtain directly from you or a Data Subject, either electronically or in hard copy:
- through use of our website(s) [and any mobile application(s)];
- enquiries about our products and/or services;
- contact by phone, by email or by any other forms of electronic communication;
- visits to our kiosks, events and/or offices;
- when a tenancy application is created or a lease or license entered into with us;
- through participation in surveys or promotions;
- when making payments to us; or
- otherwise, as a result of any other engagement with ITHRA.
Personal Data that we obtain from third parties we engage with, or are otherwise publicly available, such as:
- brokers and agents working on our behalf;
- security and facility management companies providing services for properties owned and/or managed by us;
- credit reference agencies;
- social media platforms where the Data Subjects have given permission to share your Personal Data;
- joint marketing partners; and
- fraud prevention and law enforcement authorities.
We process the following categories of Personal Data, which may include but are not limited to:
- personal contact details (e.g. name, phone number, email address, address and other contact details);
- date of birth, place of birth, gender and nationality;
- identification data (e.g. passport copies, Emirates ID / government ID copies, driver’s licenses and birth certificates);
- marital status (e.g. marriage certificate), family details and household composition;
- tenancy data (e.g. tenant details, key holder names, emergency details, defects you notify to us regarding your property, enquiries you make regarding your tenancy);
- employment data (e.g. proof of employment, work permit, residency visa, employer, employment status);
- KYC data (e.g. references, prior leasing history, prior residential addresses, sponsor details, trade licenses, VAT certificate (if applicable), powers of attorney, etc.);
- monitoring information (e.g. CCTV footage that capture and/or record your image when you visit us);
- financial data (e.g. salary/income details/certificates, outstanding rental fees – paid or in arrears, tenancy deposits, services charges, bank account numbers and statements); and
- additional data you may choose to provide us with, for example when accessing our website (e.g. username) or when we provide our products and services to you (e.g. conversations between us through emails, letters or other forms of electronic communication).
In certain limited circumstances, we may process Sensitive Personal Data. This could potentially include details about a Data Subject’s race or ethnicity, Biometric Data (e.g. fingerprints), health data and/or details about criminal convictions (e.g. police clearance certificate).

- onboarding landlords and/or tenants;
- managing the building ;
- complying with applicable laws;

- for the performance of our tenancy agreement (or other contracts or policies).
- WHO RECEIVES PERSONAL DATA AND WILL THE DATA BE TRANSFERRED TO A THIRD COUNTRY
For the purposes described in this Privacy Policy, and subject to applicable Data Protection Laws, Personal Data may be shared with recipients outside of ITHRA, such as third party property owners (of properties where ITHRA leases and manages properties) and ITHRA’s suppliers and service providers including:

Introduction
Pursuant to the data protection laws and regulations of the Emirate of Dubai and the Federal laws and regulations of the United Arab Emirates, Ithra Dubai LLC, as “Data Controller”, hereby informs you that your personal data will be processed in full compliance with current applicable legislation, and for the purposes set out below.
Subject of the Processing
Your personal data including the personal data in your curriculum vitae will be processed (personal, professional, training, interests, etc.) or in any case provided by you to Ithra Dubai LLC and/or its subsidiaries and/or its affiliates. The processing will take place in compliance with the obligations of correctness, lawfulness, transparency and protection of confidentiality and integrity according to the principles and provisions of the aforementioned legislation on the protection of personal data in the Emirate of Dubai, United Arab Emirates.
In particular, the data strictly pertinent to the obligations, tasks and purposes indicated below, which cannot be fulfilled or implemented through the processing of anonymous data or data of a different nature, will be processed.
The processing of personal data may also concern data particular categories (formerly sensitive) for any indication of belonging to protected categories which will be treated in accordance with the provisions of the current legislation on the protection of personal data.
Only the information strictly pertinent and limited to what is necessary for these purposes will be the subject, also taking into account the particular tasks and/or specificities of the professional profiles required. Any additional data provided by you that is found to be irrelevant with respect to the purposes indicated below will not be processed.
How do we collect your personal data?
We may use different methods to collect data from and about you including through:
- Direct interactions. You may give us your personal data (including sensitive personal data) by filling in forms, by corresponding with us by post, phone, email, or by visiting our offices or otherwise.
- Automated technology or interactions. As you interact with (i) our website, we may automatically collect technical data about your equipment, browsing actions and patterns; and/or (ii) our offices, we may automatically collect personal (including sensitive personal data) about you. We collect this personal data by using cookies, server logs and other similar technologies, including those introduced in connection with limiting the spread of COVID-19.
- Third partied or publically available sources. We may receive personal data about you from various third parties and public sources.
Purpose of the Processing
The data you provide will be processed by Ithra Dubai LLC for the purpose of recruiting and selecting personnel and evaluating, upon your spontaneous request or in response to an announcement, the possibility of a possible establishment of an employment relationship for present or future business needs.
Procedure of the Processing
The processing of personal information concerning you will be based on the principles of correctness, lawfulness, transparency and the protection of your privacy and your rights.
Your data will be processed in electronic and paper form and your data will be collected and stored in computer databases and may be stored in paper archives.
Processing will be carried out by personnel duly authorised in compliance with, and in application of, appropriate security measures to safeguard the confidentiality, integrity and completeness of the data processed, in accordance with the applicable data protection laws and regulations in the Emirate of Dubai, United Arab Emirates and in accordance with the instructions given by the Data Controller.
Nature of the Processing
The provision of data for the indicated purpose is optional but necessary and constitutes an essential requisite for the pursuit of the described purpose. Failure to provide your data will make it impossible to evaluate your profile and your professional aptitudes with respect to the role to be filled or any future positions that may be available and will not allow us to proceed with the selection activities for the purpose of possible establishment of the employment relationship.
Duration of the Processing
The data communicated by you (personal data, contact details, data relating to training carried out, data relating to professional experience, interests, preferred employment, any data relating to health or belonging to protected categories) are preserved for a period not exceeding six years (starting from the reception of the data), except for the contracting of the employment relationship and the consequent conservation for the time related to it.
Access to Personal Data and Communication
Your personal data may be processed by the Data Controller and by persons authorised by them who need to process them in the performance of their duties as instructed in compliance with the principles of protecting personal data.
Your personal data may also be disclosed to all subjects authorised to access it in compliance with legal provisions.
In particular, your data may be disclosed, even in the pre-contractual phase, to third party companies or professionals (both individuals and legal entities) to whom the Data Controller should entrust tasks for the performance of certain outsourced activities and duly appointed as Data Processors (e.g. personnel selection personnel, labour consultants for the purpose of preparing the necessary documentation for the possible establishment of the employment relationship, web agency responsible for managing the website, etc.).
The communication of your data to the categories of subjects referred to above is necessary to implement the preliminary obligations with respect to the possible establishment of the employment relationship.

Your personal data is not subject to disclosure.
Change of Purpose
We will only use your personal data and/or sensitive personal data for the purposes for which we collected it, unless we reasonably consider that we need to use it for another reason and that reason is compatible with the original purpose. If you wish to get an explanation as to how the processing for the new purpose is compatible with the original purpose, please contact us. If we need to use your personal data for an unrelated purpose, we will notify you and we will explain the legal basis which allows us to do so. Please note that we may collect and process your personal data and/or sensitive personal data without your knowledge or consent, in compliance with the above rules, where this is required or permitted by law.
Exercising your Rights
You may, at any time, exercise the rights recognised under the laws of the Emirate of Dubai and the federal laws of the United Arab Emirates as applicable to the Emirate of Dubai.
Specifically, you will be able to obtain from the aforementioned Data Controller who will make your personal data available to in an intelligible form; you may also obtain the erasure, transformation into anonymous form or object to data processed in violation of the law, updating, rectification or, if there is interest, integration of the data itself, or use the portability of these; may also object, for legitimate reasons, to the processing of the data.
You will also have the right to withdraw your consent to the processing at any time.
Complaints
If you believe that your rights have been violated, you may file a complaint with the relevant authorities in the United Arab Emirates.
